The Employee Benefits Consulting Group of Plante & Moran is tracking additional legislation and rules that affect employee benefit and retirement plans. As information becomes available, we will be issuing additional information so that employers can react in a timely and appropriate fashion. Forthcoming guidance will include:

  • Electronic Filing of Form 5500 – The IRS recently announced that all Form 5500s must be filed electronically for plan years beginning on or after January 1, 2008. The initial required electronic filing due date will be July 31, 2009.
  • 403(b) Plan Document Requirements – All employers that have 403(b) plans will be required to maintain plan documents and ultimate administrative responsibility, even though historically there was no such requirement.
  • Nonqualified Deferred Compensation – The technical final regulations for nonqualified deferred compensation under Internal Revenue Code 409A will be issued in the near future.
