Today the U.S. Supreme Court upheld the 4th Circuit’s decision in King v. Burwell finding that individuals that purchase health insurance through the Federal Exchange are eligible for the tax subsidies provided under the Affordable Care Act (“ACA”). The court considered whether the ACA subsidies were available only for insurance purchased on an exchange established by a state, and ultimately concluded no. This is the most recent in a line of cases in which the U.S. Supreme Court has upheld key provisions of the ACA.
